SB 340: A Simple Fix for Better Government in Nevada

If you’ve ever felt like agency regulations get out of hand or don’t make sense, you’re not alone. In Nevada, a new proposal called SB 340 is aiming to fix that—and it’s something every Nevadan can get behind. Supported by the Nevada Policy, this bill is all about making sure the rules made by government agencies stay fair, clear, and in line with what Nevada’s elected leaders intended. Here’s what it’s about and why it could be a win for everyone in the state. 

What Is SB 340? 

At its heart, SB 340 is about keeping government agencies in check. Right now in Nevada, agencies—think departments that handle everything from business licenses to environmental rules—can make regulations that affect your life, employment, or business. But sometimes, they go too far or make rules that don’t match what Nevada’s lawmakers wanted. SB 340 steps in to stop that by giving the state legislature (the people we vote for) more control over what agencies can and can’t do. 

Here’s how it works in plain terms: 

  1. A Way to Push Back: Section 3 of the bill lets regular Nevadans challenge rules they think are unfair or over the top. Maybe an agency made a rule that goes beyond what the law allows, twists what lawmakers meant, or gets applied with a wrong intent. With SB 340, we’d have a formal way to say, “Hey, this isn’t right,” and get it reviewed. 
  1. A Balanced Team in Charge: The bill brings disputes to the Legislative Commission—made up of six senators and six assembly members from both parties—in charge of double-checking these regulations. That means no single agency can just do whatever it wants. Instead, a mix of elected officials has to agree the rules make sense. 
  1. More Openness: SB 340 also makes the whole process easier to follow. It requires public hearings where people can speak up about new rules before they’re set in stone. Plus, there’d be an online list of all regulations, so businesses and regular folks can see what’s happening without digging through paperwork. 

Why This Matters for Nevada 

Imagine you run a small business, and some agency hits you with a confusing rule that costs you time and money. Or maybe you’re just a regular person frustrated by a regulation that feels unfair. Right now, it’s tough to do much about it. SB 340 changes that by giving you a voice and making sure agencies don’t overstep. 

This change is in line with the federal developments too. In a landmark decision on June 28, 2024, the U.S. Supreme Court in Loper Bright Enterprises v. Raimondo overturned the 40-year-old precedent of Chevron USA v. Natural Resources Defense Council, which established “Chevron deference,” effectively ending the practice of courts deferring to agency interpretations of ambiguous laws.  The Supreme Court, in a 6-3 decision, ruled that courts, not agencies, should decide “all relevant questions of law arising on review of agency action—even those involving ambiguous laws”.  

It’s clearly about fairness. When rules get made, they should stick to what Nevada’s lawmakers—people we elected—decided, not whatever an agency feels like doing. And with a bipartisan commission oversight, it’s less likely we’ll get stuck with extreme or one-sided decisions. 

On top of that, this bill makes government more accessible. Public hearings let everyone weigh in, not just insiders. An online registry means you don’t need to be a detective to figure out what rules apply to you. That’s especially helpful for small businesses trying to keep up or families navigating daily life. 

A Step Toward Better Government 

SB 340 isn’t about flashy changes—it’s a practical fix to make government work better for Nevadans. It’s about accountability: making sure agencies follow the law and answer to the people we elected. It’s about transparency: letting us see and speak up about the rules that affect us. And it’s about balance: keeping power where it belongs, with the legislature, not unelected officials.
