Nevada Policy’s bid to force state lawmakers to abide by our state constitution has been ongoing for more than a decade. Earlier this year, the Nevada Supreme Court heard arguments in our case regarding the state’s separation of powers clause.
For decades, state assemblymembers and senators have flouted Article 3, Section 1 of the Nevada Constitution, which states that Nevada’s government is divided into the executive, legislative and judicial branches and “no persons charged with the exercise of powers properly belonging to one of these departments shall exercise any functions, appertaining to either of the others” unless the constitution specifically states otherwise.
Today, there are 11 legislators who hold positions in other areas of government. Without action from the Nevada Supreme Court, these violations will continue.
